FAQs

What is a franchise?

A franchise enables a franchise owner (franchisee), to operate a specific business model. The franchisee pays a franchise fee and is granted a format or system developed by the company (franchisor) including the right to use the franchisor’s name for a limited time, and ongoing assistance. For example, the franchisor may provide assistance in finding a location for an outlet; initial training, an operating manual; and advice on management, marketing, or personnel. The franchisor may provide support through periodic newsletters, a toll-free telephone number, a website, or scheduled workshops or seminars.
To ensure uniformity and to protect their brand, franchisors carefully control how franchisees conduct business.

What is a business opportunity?

In broad terms, a business opportunity tends to focus on a product or service while in a franchise it is the system of delivery that is most important. Another difference is that an owner of a business opportunity generally does not use the company’s name or logo which is required with a franchise. Business opportunities can be difficult to define because not every state with a business opportunity law defines the term in the same manner.
